Residential tenancies in Ontario are governed by The Residential Tenancies Act (2006). This piece of legislation sets out the rights, obligation and duties of landlords and tenants.

Any disputes between landlords and tenants, including the termination of a residential tenancy, are decided by a tribunal named The Landlord and Tenant Board.

The Landlord and Tenant Board hears disputes relating to residential tenancies only, including the following:

  • Termination of a tenancy for failure to pay rent by the tenant
  • Termination of a tenancy due to tenant(s) persistent and chronic late payment of rent
  • Termination of a tenancy due to tenant(s), or their guests causing damage to the rental unit
  • Termination of tenancy due to the tenant’(s), or their guests’ illegal acts
  • Termination of tenancy where the tenant has seriously impaired the safety of another person
  • Termination of tenancy due to use of the rental unit that is inconsistent with it’s use as residential premises
  • Termination of tenancy due to the commission of illegal acts by the tenant/occupant
  • Termination of tenancy due to the sale of property to another person wishing to personally occupy the unit
  • Termination of tenancy due to landlord or members of the landlord’s family wish to occupy the unit personally
  • Rent increases over and above the guideline amount

The above are some of the more common reasons a landlord may want to terminate a tenancy or make an application to the Landlord and Tenant Board.
